Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets forth the rules and guidelines for your use of the CloseCall platform and services. This AUP is incorporated into and forms part of our Terms of Service. Capitalized terms not defined herein have the meanings given to them in the Terms of Service.

1. Purpose

CloseCall is a professional training platform designed to help home service industry professionals improve their sales skills through AI-powered practice conversations. This AUP is intended to ensure that all users can enjoy a safe, productive, and professional experience. You agree to use the Service in accordance with this AUP, our Terms of Service, and all applicable laws and regulations.

2. Prohibited Conduct

You may not use the Service to engage in or facilitate any of the following:

2.1 Illegal and Harmful Activities

  1. Any activity that violates any applicable local, state, national, or international law or regulation;
  2. Fraud, identity theft, impersonation, or misrepresentation of your identity or affiliation;
  3. Money laundering, financing of terrorism, or any activity related to sanctioned persons or entities;
  4. Harassment, stalking, bullying, intimidation, or threats of violence against any individual;
  5. Distribution of malware, viruses, or any other harmful or destructive code;
  6. Any activity that exploits, harms, or attempts to exploit or harm minors in any way.

2.2 Abuse of the AI System

  1. Attempting to manipulate, jailbreak, or exploit AI persona responses to generate content that is harmful, discriminatory, sexually explicit, violent, or otherwise inappropriate;
  2. Using the Service to generate, store, or distribute hate speech, discriminatory content, or content that promotes violence or intolerance based on race, ethnicity, gender, religion, sexual orientation, disability, or any other protected characteristic;
  3. Using the Service to create deceptive content, including deepfakes, impersonations of real individuals, or misleading representations of AI-generated interactions;
  4. Using AI-generated outputs from the Service to train, develop, or improve any competing AI model, product, or service;
  5. Deliberately providing false or misleading input to the AI system in an attempt to corrupt scoring, analytics, or other data;
  6. Using the Service for any purpose unrelated to legitimate sales training and professional development in the home services industry.

2.3 Technical Abuse

  1. Attempting to gain unauthorized access to the Service, other users' accounts, or any systems or networks connected to the Service;
  2. Using automated tools, bots, scrapers, crawlers, or similar technologies to access the Service or extract data;
  3. Interfering with, disrupting, or imposing an unreasonable or disproportionately large load on the Service's infrastructure;
  4. Circumventing, disabling, or otherwise interfering with any security, access control, or usage limitation features of the Service;
  5. Probing, scanning, or testing the vulnerability of the Service or any network connected to the Service;
  6. Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, algorithms, or data models of the Service.

2.4 Content and Data Abuse

  1. Uploading, transmitting, or distributing any content that infringes any intellectual property right of any third party;
  2. Sharing, publicizing, or distributing the performance data, scorecards, or leaderboard information of other users without their express written consent;
  3. Recording, capturing, or redistributing AI-generated voice outputs or other proprietary content of the Service without CloseCall's prior written consent;
  4. Using the Service to collect, harvest, or aggregate personal information about other users;
  5. Sharing your account credentials with any other individual or allowing unauthorized access to your account.

2.5 Commercial Misuse

  1. Sublicensing, reselling, renting, leasing, or otherwise commercially exploiting the Service or access thereto;
  2. Using the Service to provide a competing training, coaching, or simulation service to third parties;
  3. Using the Service for benchmarking or competitive analysis purposes without CloseCall's prior written consent;
  4. Misrepresenting your relationship with CloseCall, including claiming endorsement, partnership, or affiliation that does not exist.

3. Team Plan Conduct

If you are a Manager on a Team Plan, the following additional rules apply:

  1. You must inform all Team Members of the data that will be visible to you as described in our Privacy Policy before inviting them to the Service;
  2. You must not use performance data, scorecards, or leaderboard information obtained through the Service as the sole basis for adverse employment decisions (including termination, demotion, or disciplinary action) without independent evaluation;
  3. You must not coerce, pressure, or require Team Members to use the Service outside of reasonable working hours or in a manner that creates a hostile work environment;
  4. You are responsible for the conduct of your Team Members on the Service and must take reasonable steps to ensure their compliance with this AUP.

4. Reporting Violations

If you become aware of any violation of this AUP, please report it to us at privacy@closecallpro.ai. We take all reports seriously and will investigate promptly. You may report violations anonymously, though providing your contact information may help us investigate and resolve the matter more effectively.

5. Enforcement

5.1 Investigation. CloseCall reserves the right, but is not obligated, to monitor use of the Service for compliance with this AUP. We may investigate any reported or suspected violation of this AUP.

5.2 Consequences. Violations of this AUP may result in one or more of the following actions, at CloseCall's sole discretion:

  1. A written warning identifying the violation and requesting corrective action;
  2. Temporary suspension of your account and access to the Service;
  3. Permanent termination of your account and access to the Service;
  4. Removal or disabling of content that violates this AUP;
  5. Reporting of the violation to appropriate law enforcement authorities;
  6. Pursuit of any legal remedies available to CloseCall.

5.3 No Liability for Enforcement Actions. CloseCall shall not be liable to you or any third party for any enforcement action taken under this AUP, including account suspension or termination. Subscription fees are non-refundable in cases of termination for violation of this AUP.

6. Changes to This Policy

CloseCall reserves the right to modify this AUP at any time. Changes will be posted on our website with a revised "Last Updated" date. Material changes will be communicated in accordance with the notice procedures described in our Terms of Service. Your continued use of the Service after any changes constitutes your acceptance of the updated AUP.
